Every Beach Better rental is a street-legal Low Speed Vehicle (LSV), a real motor vehicle you drive on public roads. Please read these essentials now, so your trip is smooth and safe.
1. Safety First. Safety beats fun. Every time. An LSV handles differently than a car. Take turns slowly, keep every occupant seated and belted, do not overload it, and never allow lap riding. Driving on Emerald Coast Parkway (Highway 98) or on sidewalks is illegal. Cross Highway 98 directly at a lawful intersection. A vehicle driven on Highway 98 is recovered, and no refund is issued. Every rider stays buckled, infants and toddlers included. Florida law requires a separate child carrier or integrated child seat through age 3 (a booster is not sufficient), and a carrier, integrated seat, or booster at ages 4 and 5. You bring it. No driving under the influence of alcohol or any drug. No phone use of any kind while the vehicle is in motion, handheld or hands-free; stop in a safe, lawful place first. No off-pavement driving, no items on the roof, no exceeding the number of seat belts, and no pets other than a service animal.
2. How To Operate The Vehicle. Read the Renter Guide: how to access the vehicle, safely drive it, charge it, and use its features. Your written operating instructions and Florida LSV law summary are sent when you book and again on the day your rental begins.
3. Assumption Of Risk. An LSV is a street-legal motor vehicle you operate on public roads shared with cars, trucks, pedestrians, and cyclists. It sits higher and weighs less than a passenger car, and it can tip or roll over if turned too sharply or driven too fast for conditions. Most LSV incidents happen while turning too sharply. The risks include collision, rollover, ejection, serious bodily injury, and death.
4. Cancellation Policy. No refunds if you cancel 10 or fewer days before your start date. A $50 fee is withheld if you cancel 11 or more days before your rental begins.
5. If There Is An Accident. Call 911, stay at the scene, and notify Beach Better as soon as it is secure. Report the accident to Beach Better and to the police and Beach Better. Because your own auto insurance is primary, open a claim with your carrier and give the claim number to Beach Better.
6. Your Insurance Is Primary (Fla. Stat. 627.7263). The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida Statutes. Your own auto policy pays first for any claim arising from your use of the LSV. It is your responsibility to know what your policy covers before you drive.
7. Responsibility, Monitoring, Release And Indemnity. You are responsible for damage to or loss of the vehicle during your rental, including loss of use and reasonable fees. The vehicle is GPS and location monitored for safety and recovery, and you will inform everyone who rides. To the fullest extent permitted by Florida law, you release Destin Sunshine LLC d/b/a Beach Better, the vehicle owner, and their members, managers, employees, agents, and contractors from claims for property damage, bodily injury, or death arising out of your rental or use of the vehicle, including claims based on their ordinary negligence, and you agree to indemnify and hold them harmless from such claims, including claims by your passengers or anyone you allow to drive. This does not apply to gross negligence or willful misconduct, and as to any minor it applies only to the extent Florida law permits. Your rental is governed by the Rental Agreement you sign before your trip, which includes binding individual arbitration and class action and jury trial waivers.
